DMCA Policy

PEAK (Peaceful Power) respects the intellectual property rights of others and expects users of peak.ooo to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed through the site that are properly reported to our designated copyright agent.

Filing a Takedown Notice

If you believe that content available on or through peak.ooo infringes your copyright, please send a written notice to our copyright agent that includes all of the following:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material that is claimed to be infringing, including the URL or other specific location on the site where the material appears
• Your contact information, including full name, mailing address, telephone number, and email address
• A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf

Counter-Notice

If material you posted on peak.ooo was removed (or access to it was disabled) and you believe the material was removed as a result of mistake or misidentification, you may submit a counter-notice that includes:

• Your physical or electronic signature
• Identification of the material that has been removed and its location before removal
• A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification
• Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in the judicial district where you live, or if you live outside the United States, of any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided the original notification

Counter-notices should be sent to the same designated copyright agent identified above.

Repeat Infringers

In accordance with the DMCA and other applicable law, PEAK has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Filing a False Notice

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys' fees.
